Abstract

The laws formulated for blasphemy and contempt of religion are derived from the fundamental sources of Islamic Shariah, and the prescribed punishment for blasphemy against the Prophet (peace be upon him) is in accordance with the principles of Shariah. In addition to this, if we consider man-made laws and the Universal Declaration of Human Rights, various legal sections exist to maintain peace and order in society. This shows that under the guise of freedom of expression, insulting any religion or its sacred elements is both a legal and Shariah-defined offense, as no religion permits the disrespect of another's faith or religion.

Therefore, this research includes a discussion on the definition of blasphemy and the conditions required for its proof. It also presents a comparative analysis of the punishments for blasphemy from both the perspective of secular law and Shariah. Moreover, the study briefly touches upon the principles set by human rights organizations and provides necessary recommendations suited to contemporary times.
