Abstract

A rental agreement is a legal contract in which specific terms and conditions are agreed upon between the tenant and the landlord, under which the landlord agrees to lease their property. This agreement clarifies the rights and duties of both parties, and it is essential that these terms are formulated in accordance with Islamic principles and Sharia law to prevent any kind of deception or misunderstanding.Clarifying the rights in a rental agreement is important to ensure the protection of the rights of both parties. The tenant is entitled to use the property, but they are not permitted to use it for unlawful purposes. Similarly, the landlord has the right to intervene in the property, but this right is limited to specific actions, such as maintenance and repairs. By clarifying these rights in the agreement, both parties can avoid any potential disputes.In Islam, the importance of rent is significant because, according to Sharia, any service must be compensated with fair and agreed-upon payment. In a rental agreement, the rent must be clearly defined so that both parties have no ambiguity regarding the amount or the payment method. The tenant must be informed about how much rent they need to pay, and the timing and method of payment should also be clearly defined. Any discrepancy or unfairness in rent should be guided by Sharia to ensure that justice is maintained.Islamic jurisprudence outlines some key principles regarding rent that must be adhered to. First, the rent should be clearly defined and known. This means that the tenant and landlord must agree on the amount of rent and the conditions for payment. Secondly, the rent should not be subject to exploitation or unfair alterations. Sharia also dictates that the rent should not be determined in a way that exploits the tenant by charging excessively or undercharging the landlord unfairly.Understanding and adhering to the clarification of rights in a rental agreement, the Sharia importance of rent, and its principles and regulations not only reduces potential conflicts between the parties but also ensures justice within the Islamic economic system. Following Sharia guidance, the rental agreement should be transparent and fair, ensuring the protection of the rights of both the tenant and the landlord.
