Islam is a complete and balanced religion that provides guidance not only in matters of worship and transactions but also in economic, social, and personal aspects of life. Likewise, Islam offers clear and comprehensive teachings regarding marital life. In the matter of choosing a life partner, Islam has granted both men and women a defined role, in which mutual consent holds a fundamental place. The clear texts of the Qur'an and Sunnah emphasize that a woman's consent is essential in marriage, and a marriage conducted without her permission is not valid in Islamic law. This is supported by several authentic narrations, including the incident of Khansa bint Khidam (may Allah be pleased with her), whose father arranged her marriage without her consent, and the Prophet (peace be upon him) annulled it.
However, this freedom is not absolute; it is bounded by certain conditions and limitations. One of the key conditions is the presence and approval of a guardian (wali). The role of the wali is to provide sincere advice and guidance, not to impose his will by force. He does not have the right to dominate the decision but should act with wisdom and goodwill. There are minor differences among Islamic jurists regarding this issue; some scholars allow a mature woman to contract her own marriage, provided the man is compatible (kufu') with her in social and religious status.
Unfortunately, many misconceptions prevail in our society regarding this matter. Some believe that a marriage is not valid without parental approval, while others think a girl should not express her opinion at all. Both views are contrary to Islamic teachings. This article presents an analysis of the concept of freedom in choosing a spouse in the light of Islamic texts, addressing common misunderstandings, in hopes of promoting a better understanding of marriage in society, and fostering peace, harmony, and mutual respect within the community
