This research explores the contemporary global refugee crisis through the lens of Al-Mawardi’s classical political philosophy, specifically focusing on his seminal work, Al-Ahkam al-Sultaniyya. Amidst a landscape where modern international refugee laws often grapple with political selectivity and ethical voids, this paper investigates the Islamic legal concepts of Aman (Asylum), Hijrah (Migration), and the status of Musta’minun (Protected Aliens). By analyzing Al-Mawardi’s framework for state governance, the study demonstrates that his jurisprudence transcends historical boundaries, offering a robust ethical and administrative foundation that prioritizes human dignity (Karama) and distributive justice over mere political expediency.
The study further proposes a pragmatic "Islamic Refugee Governance Model" tailored for contemporary Muslim states and the Organization of Islamic Cooperation (OIC). By integrating Al-Mawardi’s administrative structures—such as the Diwan (Departmental Registry) and Wilayat al-Mazalim (Ombudsman)—with modern state mechanisms, the paper outlines a roadmap for unified Islamic legislation. It concludes that reviving Fiqh al-Siyar (International Jurisprudence) provides a sustainable solution to the displacement crisis, transforming refugees from a perceived "security threat" into productive social participants, thereby reasserting the legal and moral sovereignty of the Muslim world in the global humanitarian discourse.
